The police team leader Goddy Ihende who investigated the death of a 22-year old fashion designer, Oluwabamise Ayanwola, who was alledgedly raped and murdered by the driver of Bus Rapid Transit, Andrew Nice Ominikoron, has told Justice Sherifat Sonaike of the Lagos State High Court sitting in Tafawa Balewa Square, that the police conducted a forensic examination on the bus but that the report is yet to be out.
Continuing his evidence on Monday, Ihende told the trial judge that the police took samples from the bus for a DNA analysis adding that it takes time to get the result of the forensic analysis.
He said this while he was being cross-examined by the defendant’s counsel Mr. Abayomi Omotubora.
The police officer who is the seventh prosecution witness, said that the defendant picked the victim from Chevron Bus stop instead of the designated Bus Rapid Transit, BRT, Bus stop.
He said, “In my earlier answer, I said the defendant was not supposed to pick a passenger that is not in the BRT Bus stop but he went ahead and did that because he didn’t want to remit the money into the Lagos State government’s account.”
Asked if during the course of investigation if he found out whether the victim paid any fare for boarding the vehicle, the prosecution witness said that the person who would have answered that was unfortunately late.
When asked if he knew that the BRT had rules he said, “I don’t know that fact because I don’t work in the BRT. For the BRT driver to have picked the victim, it means that he had his one peculiar reason.
“We all know that late Bamise boarded that bus on February 26, 2022 and the accused person was the driver.”
Omotubora further questioned him on whether he analysed the BRT machine to ascertain the time the deceased boarded the bus.
He said,”The accused person said he picked her at about 7:00p.m, so he cannot be lying.”
When the matter came up the Attorney General and Commissioner for Justice Moyosore Onigbanjo SAN, announced his appearance leading the Director of Public Prosecution Dr. Babajide Martins for prosecution.
Ominnikoron is facing a five-count charge bordering on rape, conspiracy, felony, sexual assault, and murder preferred against him by the Lagos State government.
The prosecution said that the defendant on November 25, 2021, allegedly raped a 29-year-old lady Nneka Maryjane Odezulu, without her consent.
It said that the incident took place at about 8:00p.m at Lekki-Ajah Conservation Centre Lekki-Ajah Expressway, Lagos.
The prosecution also told the court that Ominnikoron conspired with others now at large to commit rape and murdered his 22-year-old passenger, Oluwabamise Ayanwola, a fashion designer.
It said that the defendant had sexual intercourse with Oluwabamise Ayanwola, without her consent and murdered her, at about 7:00p.m, between Lekki-Ajah Expressway and Carter bridge, on February, 26, 2022.
The prosecution also said that the defendant and others at large on February 26, 2022, unlawfully killed one Oluwabamise Ayanwola by throwing her out of a moving bus between Lekki-Ajah Expressway and Cater bridge.
The defendant was also accused of sexually assaulting a-29-year old woman one Victoria Anieke, on December 29, 2021, between Ikorodu and Mile 12 area of Lagos State.
According to the prosecutor, the offences committed is contrary to and punishable under Sections 411, 223, 260 and 165 of the Criminal Law of Lagos State, 2015.
Justice Sonaike adjourned the trial till December 12.
