Six persons; Daniel Joyingo, Adigun Sodiq, Kehinde Shola, Salaudeen Kamilu, Sodiq Usseni, and Azeez Isiaka have been discharged from prison custody for causing breach of peace.
Following a guilty plea on Thursday, Magistrate B. O. Osunsanmi of a Magistrate court, Ogba Magisterial Division, Lagos State cautioned and discharged the defendants after spending four years in detention.
Urging them to be cautious, Magistrate Osunsanmi also discharged the defendants of a one-count amended charge dated August 22, 2024 brought against them by the Commissioner of Police.
The amended information was read to the defendants on August 22, 2024, to which they pleaded guilty which states, “That you Daniel Joyinbo Joigbo, Adigun Sodiq, Kehinde Shola, Salaudeen Kamilu, Sodiq Usseni, Azeez Isiaka on the 23rd day of November 2020 of about 12:00hrs at Ebute-Metta, Lagos in the Lagos Magisterial district did conduct yourself in a manner likely to cause breach of peace and thereby committed an offence punishable under Section 168(d) of the Law of Lagos State of Nigeria 2015.”
The magistrate asked the defendants whether they understood the content of their guilty plea and the obligation of the court to give out the maximum sentence on the charge.
The defendants admitted the plea bargain on the amended one-count charge.
The prosecution counsel, the Director Public Prosecutions, DPP, Dr. Babajide Martins urged the court to sentence the defendants according to their plea agreement dated August 22, 2024.
Counsel to the defendants, T.D Ojeshino prayed the court to temper justice with mercy.
“My lord, I plead the court to temper justice with mercy as the defendants are first time offenders, some are bread winners of their families and still young of age, they have spent more time in prison over 4 years since 2020 they have been in custody. They have suffered and learnt their lessons.”
Osunsanmi having found the defendants guilty cautioned and discharged them.
