A medical expert, Dr. Oyedeji Alagbe has confirmed that a-16-year-old physically challenged lady was defiled sometimes in 2016.

The medical report rendered before a Lgaos High Court sitting in Ikeja indicated that the 32-year-old Akeem Omole, an Aluminium Roofing artisan may have defiled the girl (names withheld).
The defendant who lives at 35 Olaleye Street, Oko-Oba Agege, Lagos, is standing trial before Justice Ramon Oshodi of the Ikeja Domestic and Sexual Offences Court.
Following the evidence of the survivor who is having hearing and speech defects, she had told the court earlier that the defendant sexually assaulted her on 29th October, 2016.
Subsequently, Dr. Alagbe, a forensic examiner at the Mirabel Centre of the Lagos State University of Teaching Hospital took the witness stand on Thursday at the continuation of trial to corroborate her evidence.
According to him, the findings of his former colleague, one Mrs. Oluwatoyin Olayioye who carried out medical examination on her is indicting.
Adding that the survivor’s sexual demonstration acts, Mrs. Alupogun, the mother’s verbal account and also the vaginal examination indicate that penile vaginal penetration did occur.
While being led in evidence at the proceeding by Lagos State Prosecutor, Mr. Babajide Boye, Dr. Alagbe gave his opinion on the medical report this way: “I’m also of the opinion that there had been forceful long penetration into the client’s vaginal.”
While the defence counsel Mr. S.O Lawal tried to puncture the doctor’s evidence before the court, he stated that it had taken four days to present the victim for medical examination, thereby implying that healing process would have made it difficult for establishing a case of defilement.
But the witness noted that it doesn’t take away the fact that when she was presented for examination the doctor’s report stated: ‘She was found to have unstable gaits and was wobbling.”
“On touching her on general examination, she had multiple healed rashes.
“When her private part was examined, her vaginal was found with non-malodourous whitish discharged.”
Akeem Omole, is charged with
defilement of a child contrary to Section 137 of the Criminal Law Cap Ch. C17, Vol.3, Laws of Lagos State, 2015.
He was said to have perpetrated the act on the 29th of October, 2016 at about 3:20p.m at No. 35, Olaleye street, in Oko-Oba Agege, Lagos State in the Ikeja Judicial Division when he alledgely had unlawful sexual intercourse with her.
Further hearing has been adjourned till September 27, 2022.
