    Late MohBad: Family Lawyer Speaks On Legal Proceedings

    The family of the late singer, Ilerioluwa Oladimeji Aloba, popularly known as MohBad, has provided a detailed update on the ongoing legal proceedings surrounding his death, reaffirming commitment to pursuing justice through lawful and transparent means.

    In a press statement issued by the family’s legal representatives, through Dr. Wahab Shittu, the senior lawyer stressed that the legal team will ensure that the truth surrounding Mohbad’s death is fully established in accordance with due process.

    Coroner’s inquest and prosecutions regarding MohBad’s death

    According to the statement, the Certified True Copy of the coroner’s inquest proceedings and recommendations has been obtained and studied.

    The family said it has since commenced steps to ensure full implementation of the coroner’s findings.

    A formal representation has been made to the Lagos State Attorney-General, requesting the prosecution of those indicted in the report or, alternatively, for a fiat to be granted to the family’s legal team to undertake a private prosecution.

    “Consequent upon this engagement, the nurse and another individual alleged to have played direct roles in the fatal incident have been arraigned before the Magistrate Court in Yaba, Lagos,” the statement confirmed.

    Reopening of Police investigations

    The family’s lawyer disclosed that a petition has been sent to the Inspector-General of Police, IGP, urging the reopening of investigations into MohBad’s earlier petition alleging harassment and assault by Naira Marley and Sam Larry.

    In addition, a fresh petition has been submitted to the IGP requesting an investigation into new revelations about alleged blood stains found in the late singer’s residence.

    The statement noted that the development followed public disclosures by MohBad’s maternal aunt in a viral interview.

    “The family is resolute in seeking that all credible leads be properly examined in the interest of justice and transparency,” the legal team added.

    Appeal against DPP’s legal advice

    The family also confirmed that an appeal has been filed before the Court of Appeal to challenge a ruling of the Lagos High Court (Ikeja Division) which refused to set aside the Legal Advice earlier issued by the Directorate of Public Prosecutions, DPP.

    The DPP’s advice had discharged Naira Marley and Sam Larry before the conclusion of the coroner’s inquest.

    “The Records of Appeal have been compiled and duly transmitted to the Court of Appeal. The Appellant’s Brief of Argument has been filed, and we await the Respondents’ response within the statutory timeframe,” the statement read.

    “This appeal underscores our commitment to ensuring that due process is followed and that justice is not subverted by premature administrative decisions,” it added.

    Defamation and paternity cases

    The legal team confirmed progress in the defamation suit filed by Ms. Wunmi Aloba, MohBad’s wife, against his father, Mr. Joseph Aloba.

    It stated that all necessary court documents have been filed and exchanged, while the matter now awaits trial.

    “The family remains confident in its defence and stands ready to prove its case before the court,” the statement noted.

    On the ongoing DNA and paternity proceedings, the lawyers revealed that the court has varied its earlier order on DNA sampling. The new direction permits that the test be conducted both in Nigeria and abroad.

    They added that discussions are ongoing between counsel to agree on reputable and internationally accredited DNA testing facilities in Nigeria and the United States.

    “This exercise is being approached with utmost sensitivity, given the involvement of a minor, and the family is determined to ensure that the process is not compromised in any way,” the statement said.

    Public conduct and media ethics

    Reacting to online commentary, the family’s legal team cautioned against misinformation and unfounded allegations circulating on social media.

    “We are aware of ongoing attempts by certain individuals and groups on social media to distort facts and malign the integrity of the family and its representatives. We wish to state categorically that these false narratives are unfounded and should be disregarded,” the statement said.

    “As officers of the court and responsible citizens, we have chosen not to litigate this matter on social media. Legal proceedings are best conducted in court, not in the court of public opinion,” the lawyers added, quoting philosopher Seneca, “I will do nothing because of public opinion, but everything because of conscience.”

    Family reaffirms faith in justice system

    The family reaffirmed its confidence in the Nigerian justice system, pledging to continue cooperating with all relevant authorities in pursuit of truth, accountability, and closure.

    “We reiterate that every action taken so far has been guided by the law, professional ethics, and the overarching goal of ensuring justice for MohBad, his legacy, and his loved ones,” the statement concluded.

    The family urged members of the public to remain calm, disregard misinformation, and allow lawful processes to reach their logical conclusion, assuring that further updates would be provided as developments unfold.
