Again, the Federal High Court sitting in Abeokuta, has dismissed an application for Stay of Execution of the judgement delivered on the 27th of September, 2022 in respect of Ogun State Peoples Democratic Party, PDP, governorship primary election.

When the matter came up today, Counsel to Hon. Ladi Adebutu and the PDP, Mr. Muyiwa Obanewa had told the court that he was abandoning the application for stay of execution of the judgement of the court and would seek to withdraw it because he was almost done compiling records and transmitting same to the Court of Appeal.

Thaddeus Idenyi of Dr. Kemi Pinheiro (SAN) and co., who represented the Plaintiffs, Taiwo Olabode and others, asked for cost because they had filed a response to the application for stay of execution of the judgement of the court.

On his part, Mr. Deji Enisehin, counsel to Otunba Jimi Adebisi Lawal, urged the court to dismiss the application because it was dead on arrival issues had been joined and the Independent National Electoral Commission, INEC, had complied with the order of court by not recognising Adebutu as the governorship candidate of the PDP in Ogun State.

Ruling on the matter on Thursday, the trial judge, Hon. Justice O.O. Oguntoyinbo, dismissed the application for stay of execution of the judgement of the court delivered on the 27th of September, 2022, but refused to make any order as to cost.
