A Lagos State High Court, Ikeja has fixed November 26, 2025 for report of service and further proceedings in a suit filed against the Registered Trustees of Old Grammarian Society by two alumni of CMS Grammar School, Bariga, Lagos.

Justice Alebiosu fixed the date following a session where counsel for the parties appeared on Monday when the case was mentioned.

The Claimants; Gafa Adegboyega Ibrahim and Adeyombo Adewale filed the suit ID/9573/GCM/25 through their counsel, Christopher Oladipupo, Esq., seeking to set aside the election conducted by the 6th defendant on the 28th of June, 2025.
Also, the Claimants are praying the court to declare the election conducted by the 6th defendant on the 28th of June, 2025 as null and void.
According to Oladipupo, counsel to the Claimants in a Written Address In Support of the Originating Summon sighted by this reporter and said to have been served on the defendants, the Claimants want the court to declare an order that the extant constitution of the Society 2014 remain valid and still in force until properly repeal or amended.
They also want the court to restrain all the officers elected through the election conducted by the 6th defendant on the 28th day of June 2025, from parading themselves as officers of the society pending the determination of this suit.
The Claimants are also seeking an Order that the purported 2025 constitution remain invalid and inchoate to extend of non-compliance with the amendment process under article XX (a) & (b) of the Society Constitution 2014.
The Claimants are further seeking “And for such Order or Orders this Honourable Court may deem fit to make in the circumstances that application is supported by 9 Paragraphs affidavit deposed to by the first Claimant/Applicant.”
Other defendants are; Mr. Cyril Ogbekene, Ambassador Dapo Fafowora, Joshua Oladele Sodimu, Mr. Olu Ojo, Dr. Jagun Sikuade and Dr. Ayodeji Awobiyide.
Earlier, when the matter was called, the first defendant, the Registered Trustees of Old Grammarian Society was represented by Dele Babalola, and 7th defendants, Dr. Ayodeji Awobiyide.
Defendants’ Counsel for the first defendant, Ifeoluwa Olabode and Dr. Ayodeji Awobiyide (for himself) announced appearances respectively.
At the hearing, Dr.Awobiyide, Esq., protested non-service of processes.
However, Oladipupo, Counsel to the Claimants told the court that the defendants were aware of the case.
According to him, “It appears that the defendants have been served.
But Awobiyide said, “My Lord, I appear under protest. The reason for my appearance is that I have not been served. I just got wind of this matter.
He urged the court to ensure formal service.
When the judge responded that one of the parties is protesting, the Claimants’ Counsel, replied “My Lord, Sir, there’s a procedure for challenging service, the essence of service is to put parties on notice, since the defendant is in court, he’s aware of the matter.
The court further stated that there is no evidence of service in the court’s file.
The Claimants’ Counsel told the court, “I will leave it at the Sheriff and take a date to ensure the affidavit of service is in the court’s file.
But Awobiyide, the 7th defendant assured the court, “I’m ready to waive service if he gives me now.
The Claimants Counsel furnished him a process, after which the court directed that the Claimants should ensure proof of service on all the defendants.
Justice Alebiosu adjourned the matter to November 26 for report of service and further proceedings.
